Tuesday, October 6, 2026 - Halle Berry has asked a Los Angeles County court to restore the 50-50 custody arrangement she previously shared with her ex-husband, Olivier Martinez, for their son Maceo.
The filing comes days after Martinez obtained a temporary restraining order following allegations that Berry physically abused their son, allegations she has denied. The court has scheduled a hearing for October 16.
Berry's legal team argues that the earlier custody arrangement should be reinstated and accuses Martinez of failing to follow parts of their co-parenting agreement.
In her filing, Berry also claims Maceo has returned from his father's home angry and combative and alleges that Martinez has interfered with the boy's therapy and education. Martinez has asked the court to reject Berry's request and is seeking sole custody.
The dispute now moves toward a critical court hearing as temporary restrictions on Berry's contact with her son remain in place. Neither parent's allegations have been finally determined by the court, making the October 16 hearing an important next step in deciding custody and visitation arrangements.
