Pentagon threatens to prosecute Senator MARK KELLY by recalling him to Navy service
Tuesday, November 25, 2025 -The Pentagon has launched an investigation into U.S. Senator Mark Kelly, a retired Navy captain, after he appeared in a video urging service members to refuse what he described as “illegal orders.”
The Defense Department said it received “serious allegations of misconduct” and is considering recalling Kelly to active duty for a potential court-martial or other disciplinary action. The move marks a rare, if not unprecedented, effort to subject a sitting member of Congress — and former military officer — to military law.
According to the Pentagon, Kelly’s comments “undermine loyalty, morale, or the good order and discipline” of the armed forces. Defense Secretary Pete Hegseth criticized the message as “despicable, reckless, and false,” arguing that urging troops to disregard orders could endanger service members.
Under the Uniform Code of Military Justice (UCMJ), retired service members can be recalled to active duty if their conduct violates military law, which the department says may be the case here.
Senator Kelly responded defiantly. He rejected what he called a “bullying” tactic, saying he served this country — as a Navy pilot, astronaut, and public servant — and will not be silenced.
He stood by his call for service members to uphold the Constitution. As the investigation unfolds, the case raises urgent questions about free speech, military discipline, and the balance between civilian dissent and military authority.
