JAMES COMEY seeks to dismiss 'selective and vindictive' case against him in key hearing
Thursday, November 20, 2025-Former FBI Director James Comey has asked a federal judge to throw out the criminal case against him, calling it “selective and vindictive.”
At a Wednesday hearing, his lawyers argued that the prosecution stems from President Donald Trump’s personal animus rather than legitimate legal grounds. Comey’s team is also challenging the appointment of interim U.S. Attorney Lindsey Halligan, who they say was improperly installed just to bring charges against him.
A major point of contention: prosecutors admitted that the version of the indictment filed against Comey was never shown to the full grand jury. Under questioning, Halligan told the judge only two jurors — including the foreperson — were present when the final indictment was returned.
Comey’s lawyer called that a violation so serious it could invalidate the entire case, especially since the statute of limitations is now a key factor.
Comey’s defense also argues that the prosecution was orchestrated with improper motives: they cite Trump’s public statements demanding his prosecution, longstanding political hostility, and a refusal by career prosecutors to bring charges before Halligan’s appointment.
Support for Comey’s position is growing — over 100 former Justice Department officials from both parties have called for the case to be dismissed, saying it undermines prosecutorial integrity.
