Friday, February 18, 2022 – The inquest into the tragic death of former Nyeri Governor Wahome Gakuru took another twist after it emerged that Nyeri Governor Mutahi Kahiga and Mathira Member of Parliament Rigathi Gachagua do not want to testify over his untimely death.
The duo moved to the High Court, challenging a decision to summon them as witnesses in the inquest and they sought a review of the ruling issued by Chief Magistrate Francis Andayi on January 20, 2022.
In their application seeking a review of the summonses, Governor Kahiga and MP Gachagua told Justice Muchemi that none of the witnesses presented during the inquest have mentioned them.
They also argued that public perception about them would be eroded and their constitutional rights violated since they would be viewed as the suspects in Gakuru’s death.
Besides, they stated that they don’t have evidence to give before the court regarding the circumstances surrounding the car crash that killed Gakuru.
According to court documents, the duo stated that they found out about the crash when everyone else heard about it.
Notably, Gakuru’s family had filed an application in court seeking to have Governor Kahiga explain a statement he made after the crash.
During a requiem mass for the late governor held in November 2017, governor Kahiga stated that he had warned Gakuru not to use his Mercedes Benz due to its mechanical state.
The court also heard that Gachagua was a person of interest in the case as a witness in a matter the county was investigating.
