Tuesday, September 29, 2026 - California nightlife venues are facing a major change as new legislation makes drink-spiking prevention measures a permanent requirement.
Assembly Bill 1982, signed in September 2026, removes the previous January 2027 sunset date for requirements covering drink lids, drug-testing devices and customer notices at qualifying Type 48 bars and nightclubs.
Under the rules, customers can request a removable lid for their drink, while venues must make drug-testing devices available and display a notice informing patrons about these protections.
California’s Alcoholic Beverage Control guidance says the testing devices can include strips, stickers, straws and similar products designed to detect certain controlled substances. The measures are aimed at giving patrons practical tools to respond to concerns about drink tampering.
The move puts safety firmly on the agenda for California’s nightlife industry and gives clubs another responsibility to communicate clearly with customers.
For venue operators, the focus now shifts to consistent compliance, visible information and staff readiness, while for patrons, the message is straightforward: drink lids and testing devices are available when needed.
