Thursday, November 20, 2025-The White House is reportedly preparing a sweeping executive order that would restrict states from enacting their own AI regulations, consolidating oversight at the federal level. A draft calls for the creation of an “AI Litigation Task Force” inside the Department of Justice, tasked specifically with challenging state AI laws on constitutional grounds like interstate commerce.
Under the plan, the Commerce Department would review “onerous” state laws within 90 days and could withhold federal broadband funding from states deemed noncompliant. The Federal Trade Commission and Federal Communications Commission would also be pressed into action: the FTC would examine whether state rules violate federal law, and the FCC would develop a national disclosure standard for AI — designed to override conflicting state regulations.
Tech-industry advocates are largely backing the move, arguing that a patchwork of state-by-state AI rules could stifle innovation. But critics warn the proposal represents a power grab: they argue it undermines states’ rights and democratic decision-making, while potentially pushing legal boundaries of presidential authority.
