Tuesday, October 21, 2025-Former FBI Director James Comey has filed a motion to dismiss the criminal charges against him, arguing that the case is rooted in political revenge and prosecutorial misconduct.
The charges alleging false statements to Congress and obstruction — stem from his 2020 testimony about the FBI’s handling of the 2016 presidential investigation.
Comey’s legal team claims the prosecution was driven by “personal animus” from Donald Trump and carried out by an improperly appointed U.S. Attorney, making the entire case illegitimate.
In the motion, they describe the indictment as an “egregious abuse of power,” insisting that continuing the case would set a dangerous precedent for political retribution under the guise of justice. Legal analysts say the arguments go beyond standard procedural challenges, touching directly on concerns about separation of powers and the independence of the Justice Department.
A federal judge will now decide whether to dismiss the case before trial, which is scheduled to begin in early 2026. The outcome could have sweeping implications for how political figures and law enforcement officials are prosecuted in the future and whether this case becomes a symbol of accountability or a cautionary tale of overreach.
