Sen. MARK KELLY clashes with HEGSETH over Pentagon’s investigation into him

Wednesday, December 17, 2025 -Sen. Mark Kelly publicly sharply criticized Defense Secretary Pete Hegseth on Tuesday amid a growing Pentagon investigation into his actions, calling the probe “a bunch of bull****” and an attempt to stifle dissent within the military. 

The escalating inquiry centers on a video Kelly and other Democratic lawmakers released urging U.S. troops to uphold the Constitution and, if necessary, refuse unlawful orders — a message that drew fierce condemnation from President Trump and Hegseth, who labeled it “despicable” and damaging to military discipline.

The Pentagon has escalated the matter to a formal Command Investigation, a rare move for a sitting senator and retired naval officer, citing “serious allegations of misconduct.” 

Defense officials argue Kelly’s participation could undermine “loyalty, morale, or good order and discipline” within the armed forces because he remains subject to the Uniform Code of Military Justice as a retiree. Kelly’s legal team and allies counter that the probe is unconstitutional, politically motivated, and an intimidation tactic, with some legal experts questioning the DOJ’s basis for the investigation.

The tensions boiled over in Capitol Hill interactions this week, with Kelly accusing Hegseth of using the Pentagon to deflect scrutiny from other defense controversies and of attacking a decorated veteran for exercising free speech. 

The dispute has drawn attention from lawmakers on both sides, highlighting broader concerns about civil‑military boundaries and the political use of military justice mechanisms.
