Justice Department sues Fulton County for 2020 election records
Sunday, December 14, 2025 -In a major and urgent legal escalation, the U.S. Department of Justice has filed a federal lawsuit against Fulton County, Georgia, demanding access to detailed records from the 2020 presidential election, including ballots, ballot stubs, signature envelopes, and associated digital files.
The suit, filed in the U.S. District Court in Atlanta, claims Fulton County officials failed to comply with federal requests to turn over these documents and thus violated federal election laws. County officials have said the records are sealed and cannot be released without a court order, setting up a direct legal confrontation.
The move is part of a broader nationwide push by the DOJ’s Civil Rights Division, which has initiated multiple lawsuits against states and local governments for withholding voter data and election-related records.
The department argues that enforcement is necessary to ensure compliance with federal election laws and maintain oversight of election administration. Critics, however, warn that demanding sensitive records years after an election raises privacy, security, and legal concerns, especially when state officials maintain the materials are protected under existing law.
The lawsuit has intensified national debate over federal authority, election transparency, and political motivation. Supporters say the action is about accountability and lawful access, while opponents view it as unprecedented and politically charged given the time elapsed since the election and prior official findings.
The outcome of this case could set new boundaries for how federal agencies interact with local election systems and what access they may demand moving forward.
